Website terms of use

These terms apply to your use of cdtsolutions.net.au (the “site”), operated by CDT Solutions Pty Ltd, ABN 44 702 491 978, C/- Kappatos Consulting & Advisory, 1 Sussex St, Barangaroo NSW 2000 (“CDT”, “we”, “us” or “our”). By using the site, you agree to these terms, but your use of the site does not make you a client, supplier or service provider of CDT. If you do not agree, please do not use the site.

1. What this site is

The site describes the services we offer, shows examples of our work, and lets you request a free audit or contact us.

Nothing on this site is an offer capable of acceptance or creates a client, supplier or other services relationship with CDT. Any services CDT agrees to provide will be governed exclusively by a separate written Master Services Agreement and applicable statement of work, and these terms do not amend, limit or override either document.

2. Information on the site is general

The content on this site is general information about our services. It is not advice, and it doesn’t take account of your particular circumstances.

We try to keep the site accurate and current, but we don’t guarantee that everything on it is complete or up to date at all times.

3. Demonstrations, concept builds and examples

The site includes interactive demonstrations of how certain systems may operate. All demonstration figures and outputs are illustrative and use fictional data; they are not actual CDT client data or results unless expressly and prominently identified otherwise.

Website demonstrations, examples, calculators and marketing material do not guarantee revenue, leads, enquiries, bookings, rankings, conversion rates, cost per lead, return on advertising spend or any other commercial outcome. Actual outcomes depend on circumstances including market conditions, pricing, budget, capacity, implementation and third-party platforms, and any service-specific commitments must appear in the applicable Master Services Agreement or statement of work.

4. Intellectual property

Unless otherwise stated, CDT owns or is licensed to use the content and proprietary materials on the site, including its text, designs, code, graphics, videos, branding, name and logo, subject to any applicable third-party licence terms.

You may access, browse and print site pages for your internal, non-commercial use. Except as permitted by law or an applicable third-party licence, you must not reproduce, republish, adapt or commercially exploit a substantial part of the site, use automated means to scrape site content for commercial reuse, or reverse engineer non-public site code without our prior written permission.

5. Chat assistant (if included)

If the site includes a chat assistant, it will be automated, not a person, and will provide general information about CDT’s services and collect details for follow-up only.

If included, the assistant may be inaccurate and will not be an authoritative source of binding commitments about price, scope, capability, timing or availability. Any material commitment must be separately confirmed in writing by an authorised CDT representative through CDT’s contracting process before it binds CDT.

Our collection, use, storage and disclosure of chat data are described in our Privacy Policy.

6. Third-party links and tools

The site links to or embeds third-party services, which may include forms, booking systems, chat functions, hosting, content delivery networks and other tools. Those services may be subject to third-party terms and privacy practices and, to the extent permitted by law, CDT is not responsible for their independent performance or availability; however, this does not exclude CDT’s responsibility for its own conduct or website representations, or any right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

7. Your use of the site

You must not: (a) use the site unlawfully; (b) attempt to gain unauthorised access to the site or a connected system; (c) materially interfere with the site’s security or operation; (d) use automated tools to scrape or harvest site content or personal information for commercial reuse or other improper purposes; or (e) knowingly submit materially false information or another person’s personal information without authority.

8. Information you submit

When you submit a form or use the chat, you represent that, to the best of your knowledge, the information is accurate and that you are authorised to provide any personal information relating to another person.

How we handle that information is set out in our Privacy Policy.

9. Availability

We aim to keep the site available but do not guarantee uninterrupted or error-free access. We may change, suspend or withdraw any part of the site where reasonably necessary, without affecting rights that cannot lawfully be excluded.

10. Liability

Nothing on the site guarantees leads, enquiries, bookings, sales, reviews, search rankings, revenue, conversion rates, cost per lead, return on advertising spend or any other commercial result.

Subject to the following paragraph, CDT is not liable for loss arising solely from reliance on general website information where it was reasonable for the user to verify that information before acting, or for disruption caused by an independent third-party service outside CDT’s reasonable control, to the extent permitted by law. This limitation applies only to access to and use of the site and does not govern paid client services.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded or limited, including under the Australian Consumer Law. Where CDT supplies services to which a consumer guarantee applies and it is lawful to limit liability for a failure to comply with that guarantee, CDT’s liability is limited, at CDT’s option, to supplying the services again or paying the cost of having the services supplied again; this limitation does not apply where the services are of a kind ordinarily acquired for personal, domestic or household use or consumption.

11. Governing law

These terms are governed by the laws of New South Wales, Australia, and each party submits to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.

12. Changes to these terms

We may update these terms from time to time by publishing the revised terms on the site with a new effective date. The revised terms apply to use of the site on and after that effective date and do not retrospectively amend any Master Services Agreement or statement of work.
